The new Genetic Information Nondiscrimination Act of 2008 (GINA) became effective Nov. 21, 2009. GINA could open the door for employers' exposure to potential employment practice lawsuits. About GINAGINA prohibits discrimination, harassment and retaliation against employees or applicants for employment based on genetic information. With the rising costs of employer-paid healthcare plans, an employer may be concerned about a potential or current employee's disposition to contract a particular disease, and thus drive up the cost of the employer's health plan. If genetic information is used to determine hiring of firing, it would be illegal under GINA. This is just one example of claims under GINA.
