SFM helps employers understand illegal worker rule

 
 


SFM’s claims experts and in-house attorneys have been fielding questions from policyholders and agents on the hot-button issue of hiring undocumented workers.

“I’ve had at least 20 phone calls wanting legal counsel on the new federal rule since SFM’s recent Companion piece was published,” said Beth Mandel, senior defense counsel and director of legal training for SFM’s in-house law firm, Lynn, Scharfenberg & Associates.

This fall, a new federal rule went into effect to clarify the confusion surrounding “no-match” letters sent to employers that employ workers whose Social Security numbers do not match Social Security Administration records.

The rule also sets forth steps an employer needs to take to avoid a finding by U.S. Immigration and Custom Enforcement that it knew its employee was not authorized to work in the United States.
