Limitations to wage-loss benefits
By law, a specified number of days must pass before an injured employee is eligible to receive workers' compensation wage-loss benefits.
In Minnesota and Wisconsin, this so-called "waiting period" is three calendar days. That means benefits begin four days after any disability resulting in lost time from work. However, benefits begin from the first day of lost time if an employee is authorized off work by his physician for 10 or more days in Minnesota and seven or more days in Wisconsin.
In South Dakota, the "waiting period" is seven consecutive days. That means benefits begin eight days after any disability resulting in lost time from work.
Weekly wage loss benefits are subject to minimums and maximums established by state law.
In Minnesota, the current minimum is $130 a week or the actual wage if it is lower. The maximum is $750.
Wisconsin has no minimum. The maximum is $777.
In South Dakota, the current minimum is $286 a week or the actual wage if it is lower. The maximum is $571.
