Wage Loss Benefit Limitations

Wage-loss benefits are subject to two limits.

State waiting periods

State law requires a specified number of days to pass before an injured employee is eligible to receive workers' compensation wage-loss benefits. The number of days in the so-called "waiting period" varies by state. Each state also specifies which days count and what constitutes a day.

State minimums and maximums

Generally, workers' compensation pays two-thirds of an injured employee's average weekly wage. However, this weekly amount is subject to minimum and maximum limits set by state law.
