By registering for CompOnline, you (meaning the policyholder or employer submitting this application) agree to the following terms and conditions:
1. CompOnline is a service provided by SFM Mutual Insurance Company (“SFM”) to its customers at its sole discretion. SFM is under no obligation to provide access to CompOnline and may limit or terminate your access at any time for any reason.
Please read these terms and conditions carefully before accessing or using the service. By accessing or using the service, you agree to be bound by the terms and conditions below. SFM may modify these terms and conditions from time to time, and such modifications shall be effective immediately upon posting of the modified terms and conditions. By continuing to access or use CompOnline following such modifications, you agree to be bound by the modified terms and conditions. SFM may notify customers of the posting of modified terms and conditions by any reasonable means.
2. Your email address is required to register an account. Please note that sharing your email address with others (other employees, family or friends), or using an email address that is used by multiple people, you are granting others access to sensitive account information they may not have authorization to view, or may allow them to make changes to your account. You are responsible for protecting the privacy of and keeping your username and password confidential, and insuring that anyone accessing information through your Account is authorized to do so. SFM is not liable for any access to or use of your Account, including situations in which the access was unauthorized or unintended. This includes but is not limited to circumstances in which you inadvertently or otherwise disclose or share your username and/or password, in which you use software that automatically enters your username and/or password, or in which you have your internet browser configured to save your username and/or password.
3. The workings of CompOnline represent a trade secret and intellectual property of SFM. CompOnline is a registered trademark of SFM. The resources contained within CompOnline, and the source code used to produce them, are copyrighted by SFM. You may not disclose information about CompOnline (except for information that is already public), or demonstrate CompOnline, to anyone outside your organization without the written permission of SFM. You may request permission via our contact form at https://www.sfmic.com/contact/.
When requesting permission, please include your name, address and telephone number, and a description of the intended extent, purpose, and distribution of your copying.
4. Much of the information and many of the resources contained within CompOnline are private, confidential, and/or proprietary. You acknowledge that your user(s) may have access to sensitive and private medical information about claimants and to other confidential, and/or proprietary information within CompOnline, and you agree that such information is not for secondary release or disclosure, which release or disclosure is strictly prohibited. You agree that if any such private, confidential, or proprietary information is released or disclosed by you (including your user(s), you are responsible for any damages claimed to arise out of such release or disclosure by any aggrieved party and/or by SFM.
5. SFM will take reasonable measures to keep third parties from unauthorized access to information submitted by you and to reports requested by you that are contained in or derived from CompOnline; however, SFM does not guarantee that third parties will not have access to any information, comments, or materials that you submit to SFM through the SFM website.
6. DISCLAIMER OF WARRANTIES: SFM IS PROVIDING COMPONLINE “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. SFM DOES NOT WARRANT THAT THE SERVICE IS ERROR-FREE OR THAT ACCESS TO AND USE OF THE SERVICE WILL BE AVAILABLE OR UNINTERRUPTED.
7. SFM SPECIFICALLY DISCLAIMS ANY LIABILITY WITH RESPECT TO COMPONLINE AND ITS OTHER WEB-BASED SERVICES. SFM SHALL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING, BUT NOT LIMITED TO, PUNITIVE, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, ARISING FROM THE USE OR PERFORMANCE OF COMPONLINE OR ANY OF THE MATERIALS OR INFORMATION CONTAINED THEREIN, OR ARISING FROM ANY THIRD PARTIES’ ACCESS TO INFORMATION SUBMITTED BY YOU TO SFM, OR ARISING FROM YOUR DISCLOSURE OF CONFIDENTIAL OR PRIVATE INFORMATION TO UNAUTHORIZED PERSONS, EVEN IF SFM OR ITS REPRESENTATIVES, AFFILIATES, OR SUPPLIERS HAVE BEEN ADVISED OR MAY OTHERWISE KNOW OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions prohibit exclusion or limitation of liability for implied warranties or consequential or incidental damages, so the above limitation may not apply to you.
8. These Terms and Conditions and your use of CompOnline shall be governed in all respects by the laws of the State of Minnesota, except where such law is specifically pre-empted by federal law.
9. You have read and agreed to SFM’s Terms and Conditions of Website Use (https://www.sfmic.com/terms-of-service/) and acknowledge SFM’s Privacy Policy (https://www.sfmic.com/privacy/).
By submitting this CompOnline Registration Form and agreeing to these Terms and Conditions, I warrant that I am registering with full and complete authority to do so on behalf of the above-named organization and policyholder.
